1. Acceptance of Terms
By inviting, using, or interacting with the NetFlare Discord bot ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must immediately discontinue use of the Service. These Terms apply to all users, server administrators, and any individual who interacts with the Service in any capacity.
We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms. Material changes will be communicated through our official Discord server or website.
2. Description of Service
NetFlare is a full ER:LC server management bot that provides player management, staff dashboards, activity logs, anti-raid protection, and more for both Discord servers and Emergency Response: Liberty County (ER:LC) private servers. The Service provides anti-raid detection and prevention for Discord communities, anti-raid protection for ER:LC private servers, automated member verification, staff action logging, auto-moderation, and full ER:LC private server management through Discord. The Service is provided free of charge.
3. User Conduct
By using NetFlare, you agree to the following:
- You will not use the Service to violate Discord's Terms of Service or Community Guidelines.
- You will not attempt to exploit, reverse-engineer, or interfere with the Service's functionality.
- You will not use the Service to harass, discriminate against, or target individuals or communities.
- You will not use the Service for any illegal activity under applicable local, national, or international law.
- You will not resell, redistribute, or commercially exploit the Service or its data.
- Server administrators are responsible for ensuring the Service is configured in compliance with all applicable laws and platform rules.
4. Bot Misuse
Misuse of NetFlare includes, but is not limited to: intentionally triggering raid detection systems, using the bot to mass-ban innocent members, exploiting verification bypasses, or automating actions that violate Discord's rate limits or Terms of Service.
If misuse is detected, we reserve the right to immediately suspend or permanently revoke access to the Service for the offending user and/or server, without prior notice or refund. Severe violations may be reported to Discord Trust & Safety.
5. Intellectual Property
All content, features, code, branding, and documentation associated with NetFlare are the intellectual property of the NetFlare development team. You may not copy, modify, distribute, or create derivative works based on the Service without explicit written permission.
6. Binding Data Protection & API Key Confidentiality
NetFlare, as a corporation and legal entity, is irrevocably and contractually bound by the following obligations. These obligations are enforceable by any user of the Service and constitute a binding commitment:
We shall NEVER distribute, sell, lease, license, trade, or otherwise disclose any user data, including but not limited to Discord User IDs, Server IDs, message content, moderation logs, Roblox account data, or any other personally identifiable information, to any third party for any reason, except where strictly required by law or court order.
We shall NEVER distribute, sell, lease, license, trade, expose, or otherwise disclose any ER:LC Private Server API keys, server access tokens, or authentication credentials entrusted to us by server owners. All API keys are stored using industry-standard encryption and are accessible only to the automated systems required to provide the Service. No human operator, employee, contractor, or affiliate shall have access to raw API keys under any circumstance.
Any breach of these obligations by NetFlare shall constitute a material violation of these Terms and may entitle the affected user to seek all available legal remedies. This section survives termination or expiration of these Terms and the Service.
User data and API keys are used solely for the purpose of delivering the Service as described in Section 2. Data is handled in accordance with our Privacy Policy.
7. Limitation of Liability
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components.
To the maximum extent permitted by applicable law, NetFlare and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of data, loss of revenue, server disruptions, unauthorized access resulting from bot misconfiguration, or any damages arising from raids or attacks that bypass detection systems.
Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid (if any) for the Service in the twelve (12) months preceding the claim.
8. Service Availability
We strive to maintain high uptime but do not guarantee uninterrupted availability. The Service may be temporarily unavailable due to maintenance, updates, or factors beyond our control. We reserve the right to modify, suspend, or discontinue the Service at any time without prior notice.
9. Termination
We may suspend or terminate your access to the Service at our sole discretion, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Any data associated with your server may be deleted after a reasonable retention period.
11. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration.
